1. General
1.1 These Terms and Conditions (“Terms”) apply to the campaign (“Campaign”) organized by Kungla Investeeringu Oü (registration number 10103126, legal address Pronksi 19, 10124 Tallinn, Estonia) in Estonia, SIA AHTI (registration number 40003420708, legal address Rēzeknes iela 5E, LV-1073) in Latvia and Mecom Grupp, UAB (registration number 111733421, legal address Konstitucijos pr. 12, Vilnius) in Lithuania (“Company”) Kungla Investeeringu OÜ, an Estonian company with its registered address at Pronksi 19, 10124 Tallinn, Estonia (“Company”) regarding to any content posted on the website www.olymoments.com ( “Website”).
1.2 These Terms apply to all persons (“Participant”) posting their pictures and/or videos using hashtag #OlyMoments in social media channels Instagram and Facebook or on Website or posting their pictures and/or videos tagging the appropriate OlyBet Sports Bar: OlyBet Sports Bar in Latvia, OlyBet Sport Bar and Grill in Lithuania, and OlyBet Bar & Grill in Estonia.
1.3 At Company, we take the privacy of the Participants very seriously and we are compliant with the General Data Protection Regulation of the European Union. Therefore, we recommend you familiarise yourself with our Privacy Notice before you use our services which explains how we process the personal data you may provide to us when visiting and using the services on the Website. If you do not agree to the way we process your personal data, then the only remedy available to you is to cease the use of the Website.
2. Campaign details
2.1 The Company organizes the Campaign, which takes place from 3rd of June 2024 till 8th of September 2024. All posts made after 8th of September 2024 won’t be participating in the Campaign.
2.2 The Campaign will take place in Estonia, Latvia and Lithuania.
2.3 Only natural persons, who are over 18 years old can take part in the Campaign.
2.4 Employees or family members of the employees of the Company or its group companies are not eligible to participate in the Campaign.
2.5 To participate in the Campaign,
2.5.1 you must have reached the age of 18 (eighteen) or beyond;
2.5.2 post your picture and/or video of your nice moment using hashtag #OlyMoments in social media channels Instagram or Facebook and/or on Website; or
2.5.3 visit OlyBet Sports Bar in Latvia, OlyBet Sport Bar and Grill in Lithuania, and/or OlyBet Bar & Grill in Estonia, take the picture there and post the pictures on olymoments.com tagging the appropriate sports bar.
2.6 The Campaign is divided in three periods:
1) Period 1: 3rd of June – 30th of June
Judging Period: 2nd of July – 4th of July
Voting Period: 5th of July – 9th of July
Winners’ announcement: 10th of July ;
2) Period 2: 1st of July – 31st July
Judging Period: 1st of August – 5th of August
Voting Period: 7th of August – 12th of August
Winners’ Announcement: 13th of August
3) Period 3: 1st of August – 8th of September
Judging Period: 12th of September – 14 th of September
Voting Period: 15th of September – 19th of September
Winners’ Announcement: 20th of September
2.7 The name, address, email address and phone number of the Participant of the Campaign must be provided on the Website and will be shared to enable fulfilment of the prize.
2.8 During the Campaign three prize draws take place and the prizes are listed in Annex 1
2.9 The winnerfinalists will be selected by Pan-Baltic jury, consisting of 1 Olybet Sports Bar representative and 1 brand influencer / ambassador / athlete.
2.10 The jury will select 5 finalists.
2.11 The prize winners will be detected by social media votes (likes & shares) – most likes will win the main prize, second to fifth place smaller prizes.
2.12 Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available.
2.13 Winners of the prizes will be announced on the Website and will be contacted via email (if it is provided) or social media (if the Participant used hashtag #OlyMoments during the Campaign).
2.14 The prizes will be delivered to the location, which will be agreed with the winner or winner will pick up the prize from the place agreed with the Company.
2.15 If the winner is not available (does not answer calls and/or emails) within 5 (five ) working days, they will forfeit the right to the prize.
2.16 When the Participant takes part in the Campaign, the Company will publish the pictures on the Website. The Participant will have the right to ask the Company to remove these pictures at any time, but this request will then be regarded as withdrawal of the Participant from the Campaign.
2.17 In the event of force majeure, the Company reserves the right to cancel, terminate, modify or suspend the Campaign or these Terms, either in whole or in part, with or without notice.
2.18 The Participant will bear all the costs, which are related to the participation in the Campaign and acceptance of the prize.
2.19 The Participant can contact the Company by email: support@olybet.com in case of any questions or complaints.
3. Personal Data
3.1 The purpose of collecting personal data of the Participant is to process the delivery of the prize as the winner of the Campaign.
3.2 The personal data will be stored for the duration of 3(three) months following the end of the Campaign.
4. Intellectual Property
4.1 When your content is submitted to the Website, or posted on social media with the tag #OlyMoments, you grant the Company a worldwide, royalty-free, perpetual, revocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works of, distribute, store, perform, and display your content and any name, username, voice, or likeness provided in connection with your content in all media formats and channels now known or later developed anywhere in the world. This license includes the right for the Company to make your content available for broadcast, distribution, or publication by other companies, organizations, or individuals who partner with the Company. You also agree that we may remove metadata associated with your content, and you irrevocably waive any claims and assertions of moral rights or attribution with respect to your content.
5. Content Restrictions
5.1 You shall not upload or link to our Website, or distribute or otherwise publish #OlyMoments tagged content, which is libelous, defamatory, obscene, pornographic, racist, any gambling and gaming elements, depicts minors or is otherwise illegal material. You shall not impersonate anyone else or otherwise misrepresent your identity, affiliation or status. You agree not to provide material and misleading information knowingly and with intent to defraud. You shall not upload to, or distribute or otherwise publish on to the Website any malware, spyware, or other malicious software of files. You shall not use automated means to upload to, or distribute or otherwise publish onto, the Website, any content.
5.2 Any content which contains minors, or the elements listed above shall be removed and the person who had uploaded this content shall be disqualified from the Campaign.
5.3 Any decision to remove content is final, is not subject to dispute, and we shall not be liable to you for any content that is removed for breach of the conditions listed above.
6. Participant Warranties
6.1 By participating in the Campaign, the Participant warrants that he/she owns the rights to the social media posts, the Participant have the consent of any natural person appearing in the social media posts to participate in the campaign, and in any case, the Participant is solely legally responsible for the content he/she posts on the Website and in your social media when participating in the Campaign.
6.2 The Participant represents and warrant that he/she is at least 18 years of age and with full active legal capacity.
6.3 By using the Website, the Participant agrees that the Company Entities’ liability is limited to the maximum extent permissible in your country of residence. Liability will be limited to foreseeable damages arising due to a breach of material contractual obligations typical for this type of contract. The Company isn’t liable for damages that result from a non-material breach of any other applicable duty of care. This limitation of liability will not apply to any statutory liability that cannot be limited to liability for death or personal injury caused by our negligence or willful misconduct, or if and to exclude our responsibility for something we have specifically promised to you.
7 Governing Law and Jurisdiction
7.1 Any disputes that arise shall be settled according to the procedural laws of the Republic of Estonia.
